Privacy Policy
The short version
- We don't sell personal information, and we don't ask for more than we need. Mobile numbers and text message consent are never shared with anyone for marketing.
- We only learn who you are if you tell us — through a contact form, an email or a phone call — and we use it to answer you and to do business with you.
- Google Analytics and Google Ads cookies stay off unless you click Accept on the cookie notice. You can change your mind at any time with , also at the bottom of every page.
- Like every website, the servers that deliver this one see your IP address and browser details.
Who we are
This website, factorydatasystems.com, is run by Factory Data Systems, LLC (“FDS”, “we”, “us”), a New York company. This policy explains what information the website collects, why, who else handles it, how long it is kept and the choices you have. It also covers the information you send us by email or phone. Information you give us
Contact forms
The forms on the Home and Contact pages ask for:
- what you need help with (Contact page only)
- your name and company
- your email address
- your phone number, if you choose to give it
- your message
When you send a form, the message also records the page you sent it from and your IP address, so we can recognise and block abuse.
Email, phone and doing business with us
If you email or call us, we receive whatever you choose to share. If you become a customer, we keep the business contact, licensing, order and billing details needed to supply, license, invoice and support our software and services. When you ask for support you may send us logs, screenshots or data extracts; we use them only to resolve your issue.
Text messages (SMS)
If you agree to receive text messages from us, we collect your mobile phone number and your consent, and use them only to send the messages you agreed to receive. Message frequency varies, and message and data rates may apply. Reply STOP at any time to stop receiving messages, or HELP for help. You can also contact us at [email protected] or +1 585.237.8178.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the categories of sharing described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Information collected automatically
- Server and security logs. Our web host and Cloudflare, which delivers and protects the site, record each request: IP address, date and time, the page or file requested, browser and device type, and the referring page. These logs are used to run the site, keep it secure and fix problems.
- Spam protection on the forms. When you start filling in a form, the site issues a one-time token tied to a scrambled (hashed) form of your IP address and browser. A counter keyed the same way limits how many messages one visitor can send in an hour or a day.
- Your cookie choice. The site stores your Accept or Decline choice in your browser (browser storage named
fds-cookie-consent) so the notice doesn't come back on every page. - Google Analytics and Google Ads — only as described in the next two sections.
- Fonts and images. The site's fonts are loaded from Google Fonts, and some images from a third-party image delivery network. As with any web request, those servers receive your IP address and browser details.

Until you choose, and if you decline, the Google tag still loads but with cookie storage turned off. It then sets no analytics or advertising cookies; it may send Google limited signals without cookies (for example, that a page was viewed, and the type of device) which Google uses for aggregated measurement.
Google Analytics and Google Ads
We use Google Analytics to understand how the site is used: which pages are visited, for how long, and how visitors found us (a search, an ad or a link). Google Analytics reports to us in aggregate. We don't send Google your name, email address or message, and we don't use Analytics to identify you.
We advertise with Google Ads. If you accept cookies, Google’s cookies let us measure whether an ad led to a visit or an inquiry, and may let Google show our ads to people who have visited this site while they browse other sites (remarketing). Third-party vendors, including Google, use cookies to serve ads based on a person’s prior visits to this website or other websites. Google’s use of advertising cookies enables it and its partners to serve ads based on visits to this site and/or other sites on the internet.
You can:

- block Google Analytics on every site with Google’s opt-out browser add-on

How we use information
- to answer your inquiry, and to provide quotes, demonstrations, trials and support
- to supply, license, invoice and support our software and services
- to run the website, keep it secure, and keep spam and abuse out of our inbox
- to understand how the site is used and measure our advertising — only with your consent
- to meet legal, tax and accounting obligations, and to enforce our agreements
We don't add you to a marketing mailing list because you sent us a form or an email.
If you are in the European Economic Area, the United Kingdom or Switzerland, our legal bases are: taking steps at your request before a contract, and performing our contracts; our legitimate interests in answering inquiries, running our business and securing the site; your consent, for analytics and advertising cookies; and compliance with the law.
Who we share it with
We don’t sell personal information. Apart from the Google advertising cookies above, which are used only if you accept them, we don’t share it for advertising. We use these service providers, who handle information on our behalf:
- our web hosting provider — hosts the site and its logs, and keeps a backup copy of form messages
- Cloudflare — delivers and protects the site
- Brevo — delivers contact-form messages to our mailbox
- our text messaging provider — delivers text messages you have agreed to receive (your mobile number is used only for that)
- Microsoft 365 — our email
- Google — Analytics and Ads (with your consent) and Google Fonts
We may also disclose information when the law requires it, to protect the rights, property or safety of FDS, our customers or others, or to a buyer or successor if our business is sold or reorganised.
How long we keep it
- Inquiries and correspondence — as long as we need them to answer you and for our business relationship; after that, only as long as our normal business records require.
- Customer, license and billing records — for as long as tax, accounting and contract obligations require.
- Backup copy of form messages on our web server — a rolling log; older entries are overwritten as it fills.
- Spam-protection counters — no longer than a day.
- Google Analytics — visitor-level data for no more than 14 months.
- Server and security logs — for the limited period set by our web host and Cloudflare.
Security
The site is served only over an encrypted (HTTPS) connection. The form handler keeps its messages and logs in a private folder outside the public website, and access to our email and systems is limited to the people who need it. No method of sending or storing information is completely secure, but we take reasonable steps to protect what you give us.
Your choices and rights
You can ask us at any time to show you, correct or delete the personal information we hold about you, or to stop contacting you. Email [email protected] or call +1 585.237.8178. We may need to confirm your identity first, and we will answer within 30 days. Some records we must keep by law, such as invoices.
Europe, the UK and Switzerland. You also have the right to restrict or object to our use of your information, to receive a copy in a portable format, to withdraw your consent at any time (Cookie settings), and to complain to your local data protection authority.
U.S. states with privacy laws (such as California, Colorado, Connecticut, Virginia and others). Depending on where you live, you may have the right to know what we collect, to access, correct or delete it, and to opt out of its sale or its use for targeted advertising. We don’t sell personal information. To opt out of targeted advertising, decline cookies or change your choice in Cookie settings. You may use an authorised agent, and we will not treat you differently for exercising your rights.
Do Not Track
There is no agreed standard for how websites should respond to browser “Do Not Track” signals, so this site doesn’t respond to them. Analytics and advertising cookies stay off unless you accept them.
Children
This site is for businesses and is not directed to children. We don’t knowingly collect personal information from anyone under 16. If you believe a child has sent us information, contact us and we will delete it.
Visitors outside the United States
We are based in the United States, and information you send us is handled here and wherever our service providers operate. Where the law requires it, our main providers rely on recognised safeguards for international transfers, such as the EU Standard Contractual Clauses or the EU–U.S. Data Privacy Framework.
Our software
This policy covers the website and our business communications. Event Engine® and IntelliTrack™ are installed and run on our customers’ own systems. How they handle data is described in their documentation and governed by the applicable End User License Agreement or your agreement with us, not by this policy.
Other websites
Links to other websites, such as our license portal or Google’s opt-out pages, lead to sites with their own privacy policies. We are not responsible for how they handle information.
Changes to this policy
If we change this policy, we will post the new version here and update the effective date at the top. If a change is significant, we will say so on this page.
